Terms and Conditions

Definitions: The Company is Butler CPM LTD. The Client’ means the party or any person acting on their behalf with whom the Company contracts

All Prices quoted, whether written or verbal, are for the services listed only. Any additional services required to complete a project will be quoted for in advance and charged accordingly. 

All work is charged on a day rate and billed weekly. If the project starts but is ended prematurely, only those days already worked are charged, plus a notice period of 7 days.

Where There is a change of brief, Butler CPM LTD will inform the client in advance of any extra cost likely to be incurred.

All projects are planned to an agreed time schedule. Non-adherence to this schedule by the client may result in compromising final delivery deadlines. If this is likely to occur, Butler CPM LTD will advise the client as soon as this becomes evident and suggest an alternative solution where feasible. This may incur additional costs.

Whilst every effort will be made to achieve agreed delivery, Butler CPM LTD cannot accept liability or be held financially responsible for any targets or deadlines being missed for delivery of any work which is outside of Butler CPM LTD control.

All work produced and devised during a project, including software files and correspondence remain the property, physically, intellectually and in copyright, of the Company until full payment has been made in full and all projects costs are cleared.

Once final sign off by the Client has been provided, the Company cannot be held responsible financially or otherwise for any errors relating to that work.

It is the responsibility of the Client that all materials (including data as well as intellectual property) supplied to Butler CPM LTD by the Client will have the relevant copyrights, licences and permissions for use in the commissioned project. Butler CPM LTD will not accept responsibility/liability for infringements caused by any wrongly supplied data/materials. 

The Company reserves the right to commission freelance support or outsource any job if it is felt it is in the best interests of the Client. An outsourced job remains the property/responsibility of the Company.

Whilst taking every care to protect all data and correspondence supplied, the Company cannot accept liability or be held responsible financially or otherwise for any loss. Disputes will not be entered into.

It remains the Client’s responsibility to seek copyright protection if desired for any intellectual property provided to the Client by the Company.

If at any point during the design or development process a client wishes to cancel, they may do so but will be invoiced an amount that Butler CPM LTD judges to be proportional to the amount of work completed on the commission and further compensatory charges for any other supply costs accruing and the 7 day notice period.

Terms and conditions may be changed at any time without prior notice to its clients.

The Client is agreeing fully to the Company’s trading Terms and Conditions by commissioning our services. The client is agreeing to our terms by accepting our quote via email.

The Company reserves the right to utilize the “Late Payment of Commercial Debts (interest) Act 1998” on late payments and will claim statutory interest and compensation for debt recovery costs on outstanding payments. The Company shall be entitled to charge interest on all sums due at a rate of 8% plus a reference rate until payment is received, after as well as before any judgment is obtained. The Company shall be entitled to add to any sums due any reasonable costs and expenses (including administrative costs) incurred by the Company in obtaining payment (hereof on an indemnity basis. The Company shall be entitled to charge the Client £15.00 in respect of any cheque tendered which is not met upon presentation (and to vary this charge at any time without notice).

Once your project is live you are accepting you are happy and the full remaining balance is due. Any amendments required after live will be charged at an hourly rate according to the Price List.

All work that is quoted is in accordance with the project parameters agreed with the client. If additional project parameters are required this is charged at an additional percentage of the original quoted cost.
